《反假冒贸易协定》（Anti-Counterfeiting Trade Agreement）是一个国际知识产权协定[1]。自愿加入的国家将建立一个国际法律框架，并建立一个国际机构以外的理事机构。该协定由日本发起，并获得各大行业巨头的支持[2]。协定已于2011年底被多个发达国家签署。

背景

ACTA是一个维护知识产权的多边协议，目的是为了全面加强国际贸易中知识产权的保护[1]。自愿加入的国家将建立一个国际法律框架[3]，并建立一个类似于世界贸易组织和世界智慧财产权组织国际机构以外的理事机构[1][4]。谈判的国家形容是对“全球贸易下的仿冒商品的增加和盗版的版权保护”的回应[3]。反假冒贸易协定的范围包括仿冒商品、仿制药品和网路上的侵权行为[5]。电子前线基金会等团体反对反假冒贸易协定[6]，并指出民间团体和发展中国家被排除在讨论之外，反假冒贸易协定的发展是一个政策洗钱的例子[7]。 美国电影协会是ACTA的重大幕后支持者，并且其在向墨西哥政府推销ACTA时明确提出后者可以藉用ACTA封锁令其难堪的网站，例如WikiLeaks[2]。

ACTA的谈判中没有任何部份的国际机构[3]。ACTA最早是在2006年由日本和美国提出。加拿大、欧盟和瑞士在2006年和2007年才加入初步会谈。澳洲、墨西哥、摩洛哥、纽西兰和韩国在2008年6月加入并开始正式谈判。

153位世界贸易组织成员大部分都对该条约可能扭曲贸易，并超越与贸易有关的知识产权协定方面上的现有协定表示关注[34]。反对者还批评反假冒贸易协定移除了法律上对ISP进行保护，免于用户行为上的法律责任，实际上使ISP业者无从选择，只能遵守并且侵犯个人隐私[35]。 根据由自由软体基金会分析表示，反假冒贸易协定会要求现有ISP业者不再提供可以访问受版权或数位内容权利管理保护媒体的免费软体，免费软体和开源软体将被禁止使用[36]。

欧盟ACTA专员Kader Arif
